Approve a Letter of Opposition to Assembly Bill 1216 (Muratsuchi).

BACKGROUND
Assembly Bill 1216 (Muratsuchi) (AB 1216) requires the owner or operator of a wastewater treatment facility that is located within 1,500 feet of a residential area to develop, install, operate, and maintain a fence-line monitoring system in accordance with guidance developed by the appropriate air quality management district.
The SCAQMD, one of the most stringent air districts in the Country, diligently regulates emissions from POTW’s like the Orange County Sanitation District (OC San) through the utilization of a rigorous and progressive enforcement program designed to ensure compliance with existing regulations and to control air pollution at the source. We believe AB 1216 adds a duplicative requirement that would be unnecessary and a misuse of taxpayer resources.

PROBLEM
Without proper opposition of this bill, it could pass, which could negatively affect the OC San and our fellow wastewater agencies, along with the negative impact it could have on our infrastructure and possibly affecting our rate payers.
PROPOSED SOLUTION
Staff drafted a letter of opposition for AB 1216.
TIMING CONCERNS
It is important that OC San takes a position on this bill as soon as possible to ensure that it is taken into consideration.
RAMIFICATIONS OF NOT TAKING ACTION
If we do not take a position on this bill, it could pass, possibly affecting OC San and the wastewater industry.
