BACKGROUND

 

AB 727 seeks to ensure that additional PFAS are kept out of our environment.  Specifically, this bill focuses on prohibiting manufacturing, selling, delivering, distributing, holding, or offering for sale in the state a cleaning product that contains regulated PFAS.

 

AB 334 seeks to clarify the State’s conflict of interest law, California Government Code Section 1090.  This bill would establish that an independent contractor, who meets specified requirements, is not an officer for purposes of being subject to the prohibition on being financially interested in a contract.

 

AB 246 would prohibit any person from manufacturing, distributing, selling, or offering for sale any menstrual products that contain regulated PFAS, and requires a manufacturer to use the least toxic alternative when removing regulated PFAS in menstrual products to comply with these provisions.

 

AB 234 seeks to ensure that additional microplastics and synthetic polymer microparticles are kept out of our environment.  This bill would express the intent of the Legislature to enact subsequent legislation that would prohibit the sale of rinse-off cosmetics, detergents, waxes, and polishes that contain intentionally added synthetic polymer microparticles.

PROBLEM

 

Without proper support of these bills, they could fail, which could negatively affect the Orange County Sanitation District (OC San) and our fellow wastewater agencies, along with the negative impact it could have on our infrastructure and possibly affecting our rate payers.

 

PROPOSED SOLUTION

 

Staff drafted letters of support for AB 727, AB 334, AB 246, and AB 234.

 

TIMING CONCERNS

 

It is important that OC San takes a position on these bills as soon as possible to ensure that OC San’s positions are taken into consideration.

 

RAMIFICATIONS OF NOT TAKING ACTION

 

If we do not take a position on the bills, they could fail, possibly affecting OC San and the wastewater industry.
