RECOMMENDATION:  Recommend to the Board of Directors to:

A.       Receive and file Bid Tabulation and Recommendation for Seal Beach Pump Station Isolation Valve Replacement, Project No. FRC-0004;

 

B.       Award a Construction Contract to J.R. Filanc Construction Co., Inc. for Seal Beach Pump Station Isolation Valve Replacement, Project No. FRC-0004, in the amount of $466,830; and

 

C.       Approve a contingency of $93,366 (20%).

BACKGROUND

 

The Orange County Sanitation District (Sanitation District) owns and operates the Seal Beach Pump Station which was built in 1972 and is near the end of its useful life.  Seal Beach Pump Station Replacement, Project No. 3-67, is now in design, but will not be completed until 2026. 

 

RELEVANT STANDARDS

 

                     Comply with California Public Contract Code Section 20103.8:  Award Construction Contract to lowest responsive, responsible bidder

                     Achieve less than 2.1 sewer spills per 100 miles

                     Ensure the public’s money is wisely spent

 

PROBLEM

 

To perform pump maintenance and repairs, maintenance crews rely on isolation valves between the wet well and a pump, and between a pump and the discharge header.  In this situation, these valves are at the end of their useful life and there is an immediate risk that a valve might fail open, which would prevent a pump from being repaired, or fail close, which would prevent a pump from going back into service.  Such a failure in a wet weather event could cause a sewer spill.  The poor condition of these valves requires them to be replaced prior to the Seal Beach Pump Station Replacement Project. 

 

PROPOSED SOLUTION

 

Award a Construction Contract for Seal Beach Pump Station Isolation Valve Replacement, Project No. FRC-0004, to replace 13 isolation valves ranging in size from 14 to 18 inches in diameter.

 

To replace half of the valves, the contractor must completely bypass the pump station for several weeks using portable pumps and temporary piping.  To replace the remaining valves, the contractor will use the existing pumps.  As the pumps are in generally poor condition, there is a higher than usual risk that additional bypass pumping or other repairs may be needed to complete the work.  For this reason, staff recommends approval of a 20% contract contingency instead of the usual 10% contingency.

 

TIMING CONCERNS

 

Procurement of the valves could take up to 26 weeks and the contractor is restricted to perform the work during 2021 dry wet weather season in order to minimize the risk of potential overflow/spills while utilizing temporarily bypass pumping.  With the time required to procure the valves, delaying the award of this contract might require the work to be postponed until the next dry wet weather season in 2022.

 

RAMIFICATIONS OF NOT TAKING ACTION

 

Without replacement of the valves, the pumps may become inoperable or crews may be unable to isolate and repair pumps until the pump station is replaced in 2026.  Construction of the replacement station could also be more expensive if crews cannot rely on the existing valves to operate correctly.

The Sanitation District advertised Seal Beach Pump Station Isolation Valve Replacement, Project No. FRC-0004, for bids on September 30, 2020 and nine bids were received on November 4, 2020.  A summary of the bid opening follows:

The bids were evaluated in accordance with the Sanitation District’s policies and procedures.  A notice was sent to all bidders on November 10, 2020 informing them of the intent of Sanitation District staff to recommend award of the Construction Contract to J.R. Filanc Construction Co. Inc.  Staff recommends awarding a Construction Contract to the lowest responsive bidder, J.R. Filanc Construction Co. Inc., for a total amount not to exceed $466,830. 

 

CEQA

 

The project is exempt from CEQA under the Class 1 categorical exemptions set forth in California Code of Regulations Section 15301 because the project involves repairs, replacement, and or minor alteration of existing facilities involving no expansion of use or capacity.  A Notice of Exemption will be filed with the OC Clerk-Recorder after the Sanitation District’s Board of Directors approval of the Construction Contract.

 

FINANCIAL CONSIDERATIONS

 

This request complies with authority levels of the Sanitation District's Purchasing Ordinance.  This recommendation would be funded under the Repairs and Maintenance line item for Division 820 (Fiscal Years FY 2020-2021 and 2021-2022 Budget, Section 6, Page 76), and the available funding is sufficient for this action.
