RECOMMENDATION:
A. Ratify approval of an Emergency Repair Purchase Order Contract to Charles King Company for Lido Pump Station East Force Main Emergency Repair, Project No. FRC-0019, for an amount not to exceed $215,000;
B. Approve a contingency of $15,000 (7%); and
C. Find that Lido Pump Station East Force Main Emergency Repair, Project No. FRC-0019, is exempt from CEQA under the Class 1 categorical exemptions set forth in California Code of Regulations Section 15301 and authorize staff to file a Notice of Exemption with the OC Clerk-Recorder.

BACKGROUND
On Friday, November 4, 2022, a sewage spill occurred adjacent to Orange County Sanitation District’s (OC San) Lido Pump Station near the Newport Boulevard Arches Bridge. Approximately 9,222 gallons leaked from one of the two pressurized pipes, or force mains, resulting in a temporary closure of the impacted area of Newport Bay. Although swimming and water contact recreation were restricted for three days, subsequent testing revealed no increase in elevated bacteria levels, and the closure was lifted Monday evening, November 7, 2022.
Staff responded to the spill by taking immediate mitigating action to isolate the leak by switching flow from the pump station to the alternate force main pipeline. The spill was reported and cleaned up within a few hours. Almost all of the spilled sewage entered the local storm drain system and was subsequently discharged to the bay.
Shortly after the spill, staff prepared for an internal video inspection of the East Force Main. The force main had to be drained and piping inside the pump station removed to allow access for the inspection scheduled for November 16, 2022. The inspection identified a hole in the pipe at the approximate location where sewage was observed to be spilling out of the ground, approximately 110 feet north of the pump station. The cause of the hole or the extent of the repair could not be identified from the video footage. On Monday morning, November 21, 2022, an emergency was declared to excavate and repair the damaged force main in accordance with Ordinance No. OC SAN-56, Section 1.07.B, Emergency Procurement. On November 23, 2022, OC San met with the City of Newport Beach and the repair Contractor, Charles King Company (CKC), to plan the repair work. CKC began excavation and repair of the damaged pipeline on November 28, 2022.

PROBLEM
A sewage spill occurred adjacent to OC San’s Lido Pump Station on Friday night, November 4, 2022.
PROPOSED SOLUTION
Investigate the location of the spill and perform emergency repairs to get the impacted force main available for service pursuant to the General Manager’s use of emergency purchasing authority pursuant to Ordinance No. OC SAN-56, Section 1.07.B, Emergency Procurement.
TIMING CONCERNS
With the condition and reliability of the West Force Main in question due to the East Force Main failure, this work was declared an emergency.
RAMIFICATIONS OF NOT TAKING ACTION
Should the Lido Pump Station West Force Main also fail, the Lido Pump Station would shut down, causing a disruption of sewer services to the Newport Peninsula and likely a significant wastewater spill into the Newport Bay. The availability of the East Force Main is also required to allow the Bitter Point Trunk Sewer Repair Project (FRC-0009) to proceed with construction without major delay and cost impacts.

ADDITIONAL INFORMATION
The Lido Pump Station force mains are dual 16-inch iron pipes installed in the late 1990s. The East Force Main leak occurred approximately 110 feet north of Lido Pump Station in a landscaped area maintained by the City of Newport Beach. Irrigation, landscaping, and sidewalk repairs are required to restore this area back to its original condition.
A subsequent rehabilitation project will be planned in the near future to fully rehabilitate both force mains to extend the useful life of the pipelines for the long term.
OC San has been actively refurbishing and replacing force main pipes in its collection system. For example, OC San recently completed the replacement of the Seal Beach Pump Station force mains and has replaced or relined the force mains at A Street, Fifteenth Street, Rocky Point, Bitter Point, and College Pump Stations in the last 15 years. Projects are currently in design to replace the force mains for Bay Bridge, McArthur, and Edinger Pump Stations. The asset management program is continuing to assess the remaining force mains at Crystal Cove, Slater, Main Street, and Westside Pump Stations, as well as the previously refurbished force mains referenced above, and develop projects to refurbish the force mains as necessary.
CEQA
The project is exempt from CEQA under the Class 1 categorical exemptions set forth in California Code of Regulations Section 15301. A Notice of Exemption will be filed with the OC Clerk-Recorder after OC San Board of Directors approval of the Construction Contract.
FINANCIAL CONSIDERATIONS
This request complies with the authority levels of OC San’s Purchasing Ordinance. This recommendation will be funded under the Repairs and Maintenance line item for the Operations and Maintenance Department (Budget Update Fiscal Year 2022-23 and 2023-24, Page 75), and the available funding is sufficient for this action.
