GENERAL MANAGER'S RECOMMENDATION

RECOMMENDATION:  Recommend to the Board of Directors to:  

A.       Approve the execution of an Encroachment Agreement with the City of Newport Beach for the installation of electrical improvements located at 4141 MacArthur Boulevard, Newport Beach, California, in a form approved by General Counsel; and

 

B.       The Clerk of the Board is hereby authorized and directed to record said Agreement in the official records of the Orange County Clerk-Recorder’s Office.

BACKGROUND

 

The City of Newport Beach is implementing its FY 2024-25 Streetlight Improvement Project, which includes removing and replacing 22 streetlight electrical service cabinets throughout the city.  The project also includes installing new electrical wiring, pull boxes, concrete pads, pavement and sidewalk restoration, and coordinating with Southern California Edison for associated electrical improvements.

 

Some of the proposed work is located within an existing Orange County Sanitation District (OC San) easement, including the installation of a new service cabinet, pull box, conduit and conductors, and the abandonment of an existing service cabinet and conduit.

 

RELEVANT STANDARDS

 

•                     Protect OC San assets

•                     Maintain collaborative and cooperative relationships with regulators, stakeholders, and neighboring communities

•                     Operate and maintain facilities to minimize impacts on surrounding communities, including odor, noise, and lighting

 

 

 

PROBLEM

 

Without an Encroachment Agreement, OC San does not have a formal mechanism to document or control the installation of the proposed electrical facilities within the affected area.  Installing improvements without established terms and conditions could interfere with OC San’s existing infrastructure, access, maintenance activities, or future operational needs.

 

PROPOSED SOLUTION

 

Approve the execution of an Encroachment Agreement with the City of Newport Beach.

RAMIFICATIONS OF NOT TAKING ACTION

 

OC San will not formally approve the installation of the proposed electrical facilities within the affected area or establish the conditions under which those facilities may remain.  This could result in improvements being installed without OC San’s documented approval and without provisions to protect OC San’s existing infrastructure, access, and future operational needs.

ADDITIONAL INFORMATION

 

The improvements associated with this Encroachment Agreement have been coordinated between the City of Newport Beach and OC San to ensure that OC San’s existing facilities are not impacted and electrical service to the MacArthur Pump Station is not affected by this work.
