GENERAL MANAGER'S RECOMMENDATION

recommendation

RECOMMENDATION:  Recommend to the Board of Directors to:

A.       Find that the proposed actions are categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Section 15301 (Existing Facilities);

B.       Approve a Sole Source General Services Contract to CEMTEK KVB-Enertec, for Cengen Continuous Emissions Monitoring Systems (CEMS) Stack Sample Line Installation (FRJ-0004) Specification No. SSJ#2954 at CenGen Plant Nos. 1 and  2, for a total not to exceed amount of $1,544,424, including applicable sales tax and freight; and

C.       Approve a contingency of $154,442 (10%).

body

BACKGROUND

Orange County Sanitation District (OC San) operates Central Generation (CenGen) facilities at Plant Nos. 1 and 2.  The Continuous Emissions Monitoring Systems (CEMS) at these facilities were originally installed in 2008 under Project No. J-79-1A.  Modifications were performed under Project No. J-111 in 2015, which included installation of new inlet sample lines.  These systems monitor engine exhaust emissions to demonstrate compliance with South Coast Air Quality Management District (SCAQMD) permit limits.

Plant No. 1 has three CEMS systems, and Plant No. 2 has five.  Each system includes three emissions analyzers and associated inlet and exhaust stack sample lines, for a total of 24 analyzers.

RELEVANT STANDARDS

•                     Comply with environmental permit requirements

•                     Protect public safety

PROBLEM

The existing CEMS NOx, CO, and O₂ analyzers at both Plant Nos. 1 and 2 are obsolete.  Limited manufacturer support and spare parts availability increase the risk of analyzer failures and interruptions to required emissions monitoring.  Additionally, the exhaust stack sample lines have reached the end of their useful lives and require replacement to ensure accurate emissions monitoring and proper analyzer performance.

PROPOSED SOLUTION

Approve the Sole Source General Services Contract to purchase CenGen engine emissions analyzers and appurtenances at Plant Nos. 1 and 2, including software, installation, testing, and commissioning as a turnkey solution to support reliable emissions monitoring and regulatory compliance.

TIMING CONCERNS

Because CEMS operation is required for regulatory compliance, prolonged analyzer or stack sample line failure could result in permit deviations, reportable violations, or operational limitations.

RAMIFICATIONS OF NOT TAKING ACTION

If the contract is not approved, CenGen would continue operating with obsolete analyzers and end-of-life exhaust stack sample lines.  Equipment failures could require emergency repairs or replacement at higher cost and disrupt required emissions monitoring.

PRIOR COMMITTEE/BOARD ACTIONS

October 2022 - Approved a Sole Source General Services Contract with CEMTEK Environmental for Central Generation Automation/Continuous Emissions Monitoring Systems (CEMS) Maintenance Services (Specification No. CEMS22-27) at both Central Generation facilities for a five-year period beginning November 23, 2022, through November 22, 2027, for a total amount not to exceed $667,500; and approved a contingency of $66,750 (10%).

ADDITIONAL INFORMATION

CEMTEK KVB-Enertec, is the current supplier of record and General Services Contract provider for the existing CEMS Equipment at Plant No. 1 and No. 2, including the emissions analyzers and stack sample lines that are being repaired under this proposed sole source requisition request.

CEQA

The project is exempt from CEQA pursuant to CEQA Section 15301 (Existing Facilities), and a Notice of Exemption will be filed with the OC Clerk-Recorder and State Clearinghouse after approval by the OC San Board of Directors of the Construction Contract.

FINANCIAL CONSIDERATIONS

This request complies with the authority levels of OC San’s Purchasing Ordinance.   This item will be funded under the Repairs and Maintenance line item for the Operations and Maintenance Department Div. 870 P1 Maintenance and Div. 880 P2 Maintenance (Budget FY 2026-27 and FY 2027-28, Section 6, Pages 124 & 128), and the available funding is sufficient for this action.
