GENERAL MANAGER'S RECOMMENDATION

RECOMMENDATION: Recommend to the Board of Directors to:

A. Approve the easement quitclaim with the City of Garden Grove for abandoned sewer easements, in a form approved by General Counsel; and

B. Direct the Clerk of the Board to record the quitclaim with the Orange County Clerk-Recorder's Office.

BACKGROUND

In 1967 and again in 1977, the City of Garden Grove vacated a portion of Fourth Street, but reserved easements for the Orange County Sanitation District's (OC San) sanitary sewers and appurtenant structures. The sewer line has since been abandoned.

The City of Garden Grove is building a new public safety building over the abandoned sewer pipeline easement and has requested quitclaiming the easement. Staff believes we will no longer need the easement for any purpose in the foreseeable future.

PROBLEM

OC San reserves ownership of easements for abandoned sewer facilities on Fourth Street in Garden Grove unless a quitclaim is recorded.

PROPOSED SOLUTION

Approve a quitclaim to relinquish easement rights of the abandoned sewer facilities to the City of Garden Grove.

TIMING CONCERNS

The City of Garden Grove is planning to build a new city facility and needs the quitclaim executed prior to the start of the project.

RAMIFICATIONS OF NOT TAKING ACTION

The City of Garden Grove may incur delays to the project.
